Research On The Crime Of Triad Organizations

Crimes by the underworld property organization is an advanced form of organized crime.Compared with ordinary criminal crimes,it is more harmful,thereby it must be severely cracked down.China has stipulated related crimes of underworld property organization in the Criminal Law since 1997.However,determining whether a criminal organization constitutes an underworld property organization has been the research and exploring emphasis either in the theoretical field or in judicial practice.This article introduces a criminal case in the name of “plot loan”,and points out three controversial points,then discusses whether there are organizational characteristics,hazard characteristics,and the existence of repeated evaluations of underworld property organizations.First of all,searching for the theoretical basis.Then making specific analysis combined with the facts of the case.Finally,making a conclusion that this case constitutes the crime of the underworld property and no repeated evaluation in this case.In the end of this article,the author summarizes the thoughts and suggestions raised in this case,and hopes to make a contribution to the research and identification of underworld property organizations.
