Regulations On Tort Liability Of Network Operators’ Security Guarantee Obligations

With the rapid development of Internet information technology,network operators gain economic benefits through network technology and user flow.The application of big data technology makes the user’s personal behavior converge into a trend,and urges network operators to turn the trend and tendency into commercial interests.Things are interconnected,and intelligent devices are everywhere,all over people’s lives.The network operators who provide services use a large number of users’ information behind the scenes,supervise the operation of the platform,and bear more duty of care and review while making profits,so as to prevent the damage of infringement consequences caused by their own actions.Starting from the development of cyberspace and the expansion of the main connotation of network operators in recent years,this paper discusses the theoretical basis for network operators to bear tort liability,and analyzes the application and development of current security obligations through the case of "Pepper live broadcast",so as to promote the development of technology under the guidance of norms,the improvement of innovation ability of Internet industry and the development of the whole industry.The main content of this paper is divided into three parts.The first part is to put forward the characteristics and trends of network infringement in the era of big data.The hot discussion of "Pepper live broadcast" case is the starting point to discuss the application of security obligations in cyberspace.The second part is the main content,including the rationality analysis of the application of security obligations in cyberspace,and according to "network" The security law introduces the security protection obligation of network operators and provides the basis for network operators’ tort.The third part is the composition of network operators’ tort liability,which explains the subject of the regulation of tort liability.
