Analysis Of Tort Liability For Fraudulent Support

In practice,there are more and more cases caused by fraudulent dependency relationship.However,there is no clear legal provision on how to deal with such cases in China.Therefore,the judgment results of different courts of similar cases are partly the same,but the applicable legal basis is different.This article chose a different verdict of several typical case analysis,sum up the focus problem in such cases,and analysis from the problems of academic circles about the fraudulent raising of the different nature of legal theory,this paper argues that the fraudulent raising is classified as a reasonable infringement,and raised on the basis of discussing fraudulent claims for damages.Second part of the article,the current legal system of our country in the determination of the legal attribute of fraudulent parental lack,lack of the system are analyzed,the problems such as property of infringement of fraudulent raising,determine the fraudulent raising right subject,responsibility and damages claim Suggestions,such as the standards of the so as to better regulate this kind of problem,provide reference for maintaining the legitimate rights and interests of victims.
