Research On The Positioning And Optimization Of The Functions Of The Adjudication Committee In The Context Of Judicial Reform

The adjudication committee system was formed under my country's specific historical conditions and judicial environment.The formation of this system was influenced by unique political systems,cultural traditions and legal systems.The adjudication committee system has been produced and developed,and it has played an active role in China's judicial system.The shortcomings also gradually appeared to the public.This article attempts to reposition the function of the adjudication committee under the background of judicial reform as an entry point,and explores the function optimization path of the adjudication committee in my country.The article starts with the historical investigation of China's adjudication committee system,traces its roots and explores the causes of China's adjudication committee system,and analyzes the evolution of the function of China's adjudication committee system.Afterwards,the article focuses on the analysis of the practical difficulties faced by the function of the trial committee,such as obvious institutional administration,generalization of the deliberative matters,and the need to improve the discussion mechanism;Under the premise of this alienation situation,I propose to reposition the function of the adjudication committee under the background of judicial reform,that is,to strengthen the experience guidance function of the adjudication committee,improve the case refereeing function and implement the trial supervision function;And practice,we have established a path to optimize the function of the trial committee by strengthening the macro guidance function of the trialcommittee,weakening the case trial function,and standardizing the trial supervision and management functions,with a view to improving the efficiency of the function of the trial committee,and promoting the establishment of a sound and clear responsibility A unified,efficient and effective supervision mechanism for the adjudication committee.
