The Responsibility to Protect is a theory of international law put forward at the beginning of the 21 st century.In 2005,on the occasion of the 60 th anniversary of the founding of the United Nations.It originated from the theory of "human security".It was included in the communique of the summit of heads of government as the outcome of the conference.It puts forward a theoretical framework.As a hot topic of international human rights law,it is also one of the important issues of the United Nations in the 21 st,it opens up a new way to protect human rights.The concept combines the essence of national sovereignty principle,the principle of non-interference.It has also been actively applied to the Libyan crisis and the Syrian crisis.Now the Responsibility to Protect also faces challenges.On the one hand,it is difficult to define its legal nature,and it is not yet clear that there is a mandatory binding force.On the other hand,the connotations and procedures are vague,which leads to many deficiencies in practice.If the theory of the Responsibility to Protect can be properly applied in practice,it can reduce the occurrence of serious atrocity in a country.It plays a very positive role in protecting human rights and maintaining international order.This paper is divided into five chapters,which will introduce the connotation and practice of the concept of the Responsibility to Protect and define its legal attributes from the aspects of international treaty law,general legal principles of international law and international customary law.This paper will analyze the status and role in the implementation,and the way to take responsibility.At the same time,considering the deficiencies exposed in the implementation,the paper puts forward the corresponding ideas to improve the existing problems.Finally,it will explore the position of the Responsibility to Protect through official speeches and documents of the Chinese government,and the conclusion of one of the earlier chapters is summarized,help China cope with the emerging theory of the Responsibility to Protect.
