As the development of computer science and technology makes our life as well as the ways of interaction change rapidly,more information products and technologies lead us to a brand new age of information explosion.Personal data processed by computer system flows even faster than before,which helps companies dissect how people act,what people would like,even the trad usage among people,so that we can be provided with different tailor-made serves.Our personal data is being collected,used,processed illegally,along with enjoying the convenient serves.Recently,the disclosure of personal data and the difficulties of maintaining legal rights indicate the lack of legislation for personal data protection which people have appealed for.There are many countries had their own systemic,complete data protection act all around the world.We also have dozens of different laws about personal data protecting,but they only can be applied to particular subject and particular fronts,which demonstrates that we still don't publish a data protection act as many other countries.The present legal system cannot suitable for the social demand.To following the steps of international community,the team of social sciences institution of law has submitted a draft of personal data protection act in 2005,which demonstrated the beginning of our own legislation progress.The reason why we nevertheless still have not finished that until now,not only because of the less experience of legislation compared with European,America,German etc,but there are still many unsolved basic legal problems remained for us to work out.In face of such difficulties,we have to search more so that we can determine the direction of the Chinese personal data act.Go through and settle all these basic theoretical issues,can we toss out more specific recommendation to help enact legislation.
