Research On The Copyright Protection Of Short Video Clips

As a popular way of Internet content dissemination,Short video is in a period of rapid development,with considerable development potential and business prospects.At the same time,the relevant legal issues are increasingly prominent.In this paper,the mixed short video of film and TV series is a kind of short video produced by secondary editing of various film and TV series materials.Because it is necessary to copy and use the previous films and TV works,there are obvious natural defects in the copyright of mixed cut videos of films and TV.In the Internet era,the rapid and extensive information dissemination magnifies this defect.It is of great significance to clarify the copyright related issues,especially the standards of originality and fair use,for seeking the balance between copyright protection and freedom of expression,promoting the healthy development of short video industry and even cultural prosperity.This paper mainly includes the following contents: first of all,from the background of the popularity of mixed clip video,this paper introduces its definition and classification.Second,explore the nature of the work,especially the identification of originality,and discuss the possible protection of short video by copyright law.Third,the paper analyzes the current difficulties,the causes and specific performance of copyright disputes,and points out that fair use is a key system in the protection of copyright.Fourth,combined with the current situation of legislation in the field of copyright in China,the comparative study of the fair use system is carried out.Using 107 "four elements" judgment rules of copyright law of the United States for reference,this paper discusses the recognition standard of the fair use of mixed cut short videos.Finally,from the three perspectives of improving the fair use system,optimizing the licensing mode and establishing the concept of social co-governance,we think about how to regulate and protect the mixed short video.
