Climate change is one of the most serious problems which threat human beings' life,as it has great impacts on natural resources,ocean resources,ecosystem and national security,etc.Many reasons contribute to climate change,especially the human activities---the industrialized nations have relatively high carbon emissions or that are involved in the fossil fuel industry.However,the Small Island Developing States(SIDS for short)which locate in the vast ocean and rank among the list of most undeveloped nations are the biggest victim of climate change.Although the international society has done their effort to reduce the emission of greenhouse gas,the threats of climate change to the SIDS still do not diminish.In the perspective of international law theory,the SIDS are able to seek for legal remedies of climate change.In the international law framework,the system of state responsibility makes it possible for the SIDS to protect their legal rights.They proposal the related nations to take the national responsibility.Besides that,relevant conventions afford helps to the SIDS.Due to the specific conventions,they can claim that the parties who shoulder the obligation should fulfill their duty and compensate for losses.While in practice,all these legal remedies have difficulty to realize.The SIDS should not only promote strategic measures to respond to climate change and seek for other remedies excluding the international law field,but also need the assistance and support of the international society.There are three chapters in this paper.The first chapter introduces the general background of sea-level rise,analyzes the basic situation and development status of SIDS,and then proposes to analyze the impact of sea-level rise on the territory and maritime rights of SIDS,the human rights of residents of SIDS and the qualifications of the main body of international law of SIDS;the second chapter discusses the impact of sea-level rise on small island countries.The third chapter puts forward solutions and corresponding legal options: in view of the problems of the sea-level rise,the sea jurisdiction of the small island states,the protection of the human rights of the residents of the SIDS,and whether the submerged small island states retain their international legal personality,The last part is the conclusion.
