With the development of information network society,the birth of deep linking technology provides users with more convenient and fast to information.However,it can not be ignored that the abuse of deep linking technology also has an impact on the economic order of China's copyright market.The infringement of deep link actors will cause great damage to the legitimate rights and interests of the chain,copyright owners and other related rights holders.At present,China's law has not yet clearly defined the legal nature of deep linking behavior,and there is a lack of explicit provisions on the path of criminal law regulation of such behavior.In judicial practice,the judge's own different understanding of deep links inevitably affects the final judgment.For the deep link behavior,China's criminal law should be regulated.This paper focuses on the deep link infringement.In order to clarify the criminal law regulation path of deep linking behavior,we need to analyze the connotation and characteristics of deep linking.According to the different objects of deep linking behavior,it can be divided into two modes: the authorized public legal works and the unauthorized infringement works.For the current judicial identification criteria of deep linking behavior,both server standards and user perception standards are biased.By comparison,we conclude that it is more appropriate to measure it by the standard of substantive presentation.Secondly,we should analyze the copyright infringement attribute of deep linking behavior.In many judgments,the court infringes the right of information network dissemination according to the deep link behavior,and then judges that the defendant belongs to the infringement of copyright.In copyright law,the core of information network dissemination behavior lies in the dissemination and provision of works.Deep linking behavior has the nature of communication and belongs to the act of providing works.Therefore,the deep link behavior should belong to the information network dissemination.It can be seen that the mode of deep link infringement is direct.How does the infringement of deep links rise to the crime of copyright? What is the specific way of its criminal law regulation? Comparing the civil and criminal cases involved in deep linking behavior,we can find that copyright infringement wants to rise to the crime.According to the law,for profit,without the permission of the copyright owner and the act of distribution are essential elements of crime.For the purpose of making profits,the perpetrator carries out the act of distribution without the permission of the copyright owner,thus constituting the crime of infringing copyright.Is deep linking behavior a publishing behavior? With the expansion of judicial interpretation in China,the behavior of information network communication has been included in the scope ofissuance behavior.Therefore,the infringement of deep links with elements of crime should be regulated by the crime.The criminal law regulation path of the deep link infringement of authorized and public legal works is undoubtedly the principal offender of the crime.However,it is not appropriate to act as a direct principal in the deep linking of unauthorized infringing works.If it is regulated by the traditional accomplice theory.If there is no joint criminal intent between the chain setter and the chain holder,the tort can not be regulated by criminal law.The theory of one-sided accomplice is the only way.Even if there is no joint criminal intent between the two parties,as long as the illegal act is carried out and the chain setter helps the illegal act of the chained person,the joint offender of copyright infringement can be punished.
