| The appearance of the Internet has changed the whole human beings' life styles.With the rapid development of Internet,Internet has been a hotbed for criminals.Setting up gambling on the web is that kind of the crime.Opening casinos on Internet behave a new trend of crime,lead a severe challenge to the criminal laws.Under the stimulation and influence of the Internet,traditional gambling behavior develops continuously,give birth to the crime form of online gambling.Criminal take the Internet as a platform,set up gambling website,solicit gamblers to gamble,In the past two years,even developing a new trend of gambling with instant messaging tools such as We Chat and Alipay.Crime of opening "online casino" is becoming more and more serious,the amount involved in the case has reached a record high and the number of people involved in the case has broken the record.In order to deal with the new criminal pattern,In 2005 the Supreme People's court and the Supreme People's Procuratorate issued < the on Several Issues concerning the specific application of law in the handling of criminal cases of gambling interpretation>,in 2010 the Supreme People's court and the Supreme People's Procuratorate,Ministry of Public Security issued <the opinions on Several Issues concerning the application of law in the handling of criminal cases of Internet gambling>.But,We can't completely deal with the situation in judicial practice,currently,the identification of "online casinos" is still a difficult problem in legislation and judicial practice.The Supreme People's Court released the two guiding cases No.105 and No.106 issued by the Supreme People's Court,which are of great guiding significance to the identification of "online casino" in the crime of setting up casinos.There are a large number of cases in China's judicial practice that are punishable by the crime of setting up casinos.at the same time,there are many gambling-like behaviors in real life,which make it difficult for citizens to distinguish which situations can be identified as "online casino",thus leading to thinking about how to identify "online casino".Through the use of empirical analysis to find relevant cases on China's referee documents online,the article will summarize the basic types of "online casino" identification: establishment type,agency type and attachment type.At the same time,it sums up the reasons for judging "online casino" in judicial practice,and finally it can be concluded: casino elements,personnel elements and social harmfulness elements.Then,starts with the doctrine of criminal law and analyzes the doctrinal problems of "online casino".First,there are some deficiencies in the expression of "online casino" in the current legal provisions,including unclear provisions in the criminal law,lagging judicial interpretation and limitations in guiding cases.Second,the current judicial interpretation method of China's criminal law is not flexible enough,resulting in contradictions with the ever-changing "online casino".Third,lack of explanation for the essence of "online casino".On this basis,summarizes the identification rules of "online casino",using objective interpretation to seek the actual meaning of criminal law in the current social life,taking the method of extended interpretation to interpret emerging platforms such as gambling sites and We Chat group as "online casinos" in the crime of setting up casinos,At the same time,the conflict between formal interpretation and substantive interpretation has existed for a long time in the field of criminal law,this article analyzes the legitimacy of substantive interpretation in the process of "online casino".In summary,establishes the identification standard of "online casino",on the premise of observing certain limits,sums up five specific identification standard: firstly,the gambling scale and the number of participants are large;secondly,it is for profit;thirdly,it has gambling behavior;fourthly,it forms a chain of casino interests;lastly,it is profitable.Based on the above summary of the identification of "online casino" in the crime of setting up casinos,this paper makes an analysis and summary from the aspects of fact identification and legal application,thus providing useful reference for future legislative work and judicial practice. |
