As the leading industry of the national economy,the real estate plays a significant part in the economic structure of our country.On May 1st,2016,the policy of transformation from business tax to value added tax carried out when the real estate industry began to pay value added tax instead of business tax.Since the reform,both the national tax bureau and the real estate enterprises are facing challenges of many aspects.According to the continuous value added tax policy,the rules of new invoice,the new prerequisite of declare deduction,and the new tax preferences have tremendous changes.The real estate enterprises keep exploring the legal and reasonable methods to reduce the tax burden while the national tax bureaus keep researching intensively on lifting the tax collection and administration efficiency of those enterprises.Not only judging the risk through the matters of taxation rely on the current tax collection and administration system and data analysis platform,but also probing deeply into the present situation of real estate industry and the business operation process.Tax bureau should make efforts to grasp each value added tax collection and administration risk point of each business operation link,and forma complete chain of industry management.This article divided real estate developing business to four tax related segments through literature research and third party information acquisition.The four tax related segments are tax payment in advance,purchasing,sale and invoicing.Combining my own working experience in the Sichuan Provincial Taxation Bureau's investigation of the real estate industry in Sichuan Province and participating in the preparation of risk management guidelines for real estate development enterprises,I conducted analysis of the tax data compilation of those enterprises.The linkage data analysis,corporate interviews,and field visits have been conducted to obtain first-hand information for sample companies that meet the requirements.The management risk of value added tax existing in various business links has been assessed,identified and collected.At the same time,combined with the visits to typical cases of real estate development company,the management risks of value added tax acquisition that may be involved in real estate development enterprises are categorized into five categories:tax policy,supervision,law enforcement,taxpayer behavior and information utilization.The main reason is that both sides have the problem of insufficient policy understanding.From the perspective of enterprises,the foundation of value added tax policy is weak,and the need to strengthen the sense of honesty and taxation is a major factor restricting its honest declaration of taxation to the tax authorities;from the perspective of taxation authorities,the lack of professional recruitment personnel and the imperfect tax assistance system have affected the accuracy and efficiency of the management of real estate development enterprises.In addition,it is also noted that the asymmetry of the information collected by tax authority,real estate development enterprises and the third-party public-sector organizations is also an objective factor that causes real estate development enterprises to form a management risk.Based on the analysis of risk categories and causes,this article proposes a feasible risk management strategy,including tamping the foundation of policy implementation,optimizing the structure of supervision and management,perfecting risk early warning mechanism,improving the information sharing mechanism,and building a linkage management platform.It is expected that creating guide value for the effective management and control of the risk of VAT collection and management in real estate development enterprises,and for the standardization of VAT collection and management in real estate development industry.It also has certain reference significance for other industries and other taxes management in tax department.
