Abstract/Summary:
This thesis focuses on the use of new information technologies and communication within relationships.;As for the structure of the envisaged work constituted four major chapters turn in several general sections.;The first chapter has a fully introductory character, and in trying to establish the same basis in the context of the topic that will be further deepened.;The same has five sections which contemplated the significant progress that has been new information technologies and communication in all areas of society and especially in the economic field, contributing equally, some brief notes on the knowledge society. Similarly, we analyze how the impact of new information technologies and communication, in turn, leads to a series of consequences for the law. In this same section, we see the change in the structure of labor relations that have led to the emergence of new forms of organization of work activity, such as teleworking.;The second chapter is divided into six sections that are shelling the elements that make up the figure of telework.;We performed a preliminary analysis of the legal characterization of this new form of organization of the workplace, if you have studied the characteristics of the employment relationship, and if so, their inclusion in a specific contractual figure.;They also cover issues such as working hours, holidays or compensation, to try to determine whether this new form of organization of work activity involves changes in them.;At the same time, referring to contract work at home, as a prelude of telework.;The third chapter deals with the use of technological means of the company by employees and is comprised of three sections. In this chapter addresses the issue of the use of email, addressing the issue of personal use, so to get back to know the issues that arise with respect to such use for union purposes.;Then analyze what they are and what happens to the fundamental rights which are presented in the problem of email use by workers, pointing the same way the principle of good faith that must also apply in this particular matter.;Meanwhile, the fourth chapter focuses on the powers of the entrepreneur and new forms of labor activity control and is divided into seven sections. A study on the implications of the powers held by the employer, its origin, the rules, principles ... so back to lecture on the conflict that occurs between these powers and the use of new technologies of information and communication within the company.;It also discusses new forms of labor activity control.;It discusses the changes which have been produced in this field about the impact of new information technologies and communication, as well as their evolution. Special emphasis is placed on the use of visual mechanisms, as well as control of the computer and email.;Similarly, in two figures deepens as concrete are control using radio tags and control performed by the GPS device.;Finally, a brief section is incorporated in the addressed, succinctly, the most relevant aspects of labor reform, since it directly affects the subject matter herein.
