Abstract/Summary:
This thesis compares the approaches of Canadian common law and Ukrainian civil law to the problem of buyers' remedies for the breach of delivery of sale of goods. This thesis explains the emphasis which Canadian common law places on substitutional relief and the exclusive preference of Ukrainian civil law's reliance on specific relief not in terms of the general differences between civil and common law approaches to buyers' remedies for breach of delivery of sale of goods, but in terms of the interference of economic and political pressures on the functioning of Ukrainian civil law in practice. The planned economy and the administrative structure which governs the realization of the plan are the sources of this interference. In this sense, buyers' remedies for breach of delivery of sale of goods represents one aspect of Ukrainian law which reveals the administrative legal characteristics of what has been called civil law in the Soviet Union.
