| For many years,the artificial breeding wild animals in China has played a positive role in the protection,development and utilization of wild animals.However,due to the imperfection of the legal regulation system of artificial breeding wild animals,the activities related to artificial breeding wild animals also pose a huge threat to the protection of wild animals.There are many problems in the legal regulation system of artificial breeding wild animals in China,such as the legislative concept emphasizing utilization and neglecting protection;the scope of artificial breeding license is obscure,and the license conditions are loose;there is no specific management system of artificial breeding wild animals’ archives or special marks;the punishment standard for the behavior of wild animals without license is low;the administrative supervision power of artificial breeding wild animals is not allocated in a reasonable manner and the mechanism of supervision responsibility investigation is not perfect.This thesis will analyze the above problems in the legal regulation system of artificial breeding wild animals in China,and put forward specific suggestions for improvement.In order to improve the legal regulation system of artificial breeding wild animals in China,we should abandon the traditional concept of emphasizing utilization and neglecting protection,taking the basic national conditions of our country into consideration,adopt the concept of combining exploitation and protection,embody the basic requirements of ecological ethics,and take the road of sustainable development.The scope of national key protected wild animals for commercial artificial breeding shall be narrowed through legislation,and the artificial breeding of non national key protected wild animals shall be included in the management scope of artificial breeding license system.We should formulate management measures for archives and special marks of wild animals in artificial breeding to ensure traceability of wild animals in artificial breeding and facilitate law enforcement and supervision.It is advised to establish a management supervision system of unified supervision and labor division,with emphasis on the former,and avoid management standards inconsistency and wrangle caused by multiple management.We will improve the system of accountability for regulatory responsibilities and urge the regulatory authorities of artificial breeding wild animals to perform their duties in accordance with the law.By constantly improving the legal regulation system of artificial breeding wild animals,standardizing the industry of artificial breeding wild animals,cracking down on the illegal artificial breedingwild animals and the illegal use of artificial breeding wild animals,we can change the concept of public consumption,strengthen the public consciousness of animal protection,avoid the overuse of wild animal resources and affect the protection of ecological environment,and achieve a balance between wild animal protection and utilization,and push forward to build ecological civilization. |
