Comparative Study On The Eu Reach System And Legal System For The Prevention And Control Of Chemical Pollution In China

As a necessary material for modern production and life,chemicals greatly promote the development of economy and society.Chemicals are characterized by various types,complex nature and great harmfulness,in the process of production,use,storage,transfer and disposal of chemicals,it may cause pollution and damage to human health and ecological environment.Therefore,the issue of chemical pollution has become an issue of general concern to the international community.The prevention and control of chemical pollution is a systematic project,which needs the cooperation of economic,social,scientific,technological and legal means.Legal means are the guarantee of chemical pollution system.The EU REACH(concerning the Registration,Evaluation,Authorization and Restriction of Chemicals)came into force on June 1,2007.The REACH system is a new type of technical legal means which integrates chemical safety management,pollution prevention and quality standards launched by EU.Its emphasis on human health,protection of ecological environment and prevention of chemical hazards represents the international trend of chemical pollution control in the future,and its application of chemical registration,assessment and restriction system plays an important role in the prevention and control of chemical pollution.Since then,the United States,Japan,South Korea and other countries have promulgated similar laws and regulations suitable for their own countries.At present,China has not yet established comprehensive laws and regulations on the prevention and control of chemical pollution,and there is still a big gap between the legal system on the prevention and control of chemical pollution and the EU.The author hopes that this paper can provide feasible suggestions for the prevention and control of chemical pollution in China.Specifically,including the introduction,this paper consists of six chapters.The main structure is as follows:Chapter one is the introduction.A general description of the research background,significance,current situation,contents and methods.Chapter two is the general situation of prevention and control of chemical pollution in China and Europe.This chapter reviews the legislative background and reform of REACH in the European Union,introduces the overall composition and essence of reach,and expounds its role and significance in the prevention and control of chemical pollution.Chapter three is the comparison of chemical pollution control models between China and Europe.This chapter compares the legal system construction,pollution prevention concept,chemical safety management organization of chemical pollution prevention and control in China and Europe,and analyzes the shortcomings of chemical pollution prevention and control mode in China.Chapter four is the comparison of chemical registration,evaluation and restriction systems between China and Europe.This part compares the three most important systems of prevention and control of chemical pollution in China and Europe,and analyzes the shortcomings of China’s chemical registration,assessment and restriction systems.Chapter five is the comparison of the technical support systems of chemical pollution control between China and Europe.This part compares the chemical quality standards and chemical information data that support the prevention and control of chemical pollution,and analyzes the shortcomings of the technical support of chemical pollution prevention and control in China.Chapter six is the Enlightenment of REACH system to the construction of the legal system for the prevention and control of chemical pollution in China.On the basis of the above research,drawing a conclusion.In view of the deficiencies in the mode of chemical pollution prevention and control,the mechanism of chemical registration,assessment,restriction and the construction of technical support system for chemical pollution prevention and control in China,this chapter puts forwardsuggestions from the perspectives of establishing and improving the mechanism,expanding the scope of chemical hazard risk assessment and technical support construction,so as to improve the legal system of chemical pollution prevention and control in China.
