| As an environmental civil public interest litigation case,environmental pollution case of “Friends of nature” Suing “China Petroleum Corporation” has attracted people’s attention.After the defendant raised the objection to the jurisdiction during the defense period,there are great disputes between the two parties and the court on whether China Petroleum Corporation is a proper defendant in this case and how the competent court determines that it is more conducive to environmental protection.The emergence of disputes reflects the inconsistency and ambiguity on determination of parties and courts of jurisdiction and on the scope of the review of the jurisdiction objection.Under this circumstances,the author takes environmental pollution case of liability dispute of “Friends of nature” Suing “China Petroleum Corporation”as the research object.On the basis of careful analysis and interpretation of the dispute focus of the case,the author clarifies his own opinions on the disputes concerning legal issues,in order to improve the improvement of relevant issues.The paper is divided into three parts.The first part is the introduction of the basic situation of the case and the trial of the courts at all levels,and through the review of the trial of the courts at all levels,the author summarizes the focus of the dispute in this case.The second part is the legal analysis of the dispute focus of this case,that is,whether the defendant China Petroleum Corporation is qualified in this case,how the competent court of this case determines that it is more conducive to environmental protection,and whether the court’s check of the defendant China Petroleum Corporation’s subject qualification is beyond the scope of jurisdiction objection.The third part is the thinking caused by this case,that is,the author clarifies the determination of the parties when the branch company causes damage,and puts forward some suggestions on the improvement of the cross regional centralized jurisdiction system of environmental resources cases and the jurisdiction objection system. |
