Research On Fund Management System Of Environmental Public Interest Litigation In China

Since 2015,the environmental public interest litigation system has become an important environmental justice system in China,which has become increasingly important in reducing environmental pollution and preventing ecological damage.However,the fund management system of environmental public interest litigation in China is not perfect,which seriously affects the further development of environmental public interest litigation.The problems of the fund management system of environmental public interest litigation in China are mainly reflected in the lack of unified and standardized environmental public interest litigation fund management legal provisions,environmental social organizations lack financial support to file lawsuits,so they have to bear greater financial pressure and litigation risks,resulting in their low enthusiasm for filing lawsuits.The fund managers of ecological environmental damage compensation is chaotic,the fund management procedure is not perfect,the lack of professional team management,resulting in the low efficiency of the use of funds,funds idle,the effect of environmental restoration is not good.According to practical experience in different areas and foreign country.this article propose to establish a unified environmental public interest litigation foundation operating independently under the supervision of the government,the foundation will manage the compensation for environmental civil public interest litigation,environmental civil public interest litigation attached to criminal,lawsuit for damages to ecological environment and other lawsuits involving environmental public interest damage.The foundation adopts the trust management mode to ensure the value preservation and increase of funds.Set up special emergency funds for environmental civil public interest litigation in the foundation,and set up professional teams to prevent the occurrence or expansion of ecological environmental damage before or during environmental public interest litigation;set up a special fund for environmental public interest litigation assistance and a professional team to support social organizations in filing environmental public interest litigation in the foundation.Set up a special fund for environmental restoration in the foundation and set up a professional team to take charge of environmental restoration;Set up a special fund for environmental public interest compensation in the foundation to provide economic compensation to victims who have suffered heavy losses due to environmental public interest damages caused by environmental public interest litigation when they cannot receive any compensation.Through professional teams and fund management,problems such as the confusion of environmental restoration fund management and the lack of financial support for environmental social organizations to file lawsuits should be solved...
