Study On Cooperative Law Enforcement Mechanism In Watershed Environmental Governance

Governance model in China has gone through the path of sub-regional governance,gradually carrying out cooperative governance,and then building normal collaborative governance.Under the background of ecological civilization strategy in the new era,the concept of holistic watershed governance arises at the historic moment,and the establishment of long-term collaborative watershed law enforcement mechanism has become a key link of watershed environmental governance.Although the mode of collaborative law enforcement in river basins is actively explored by means of signing environmental protection cooperation agreements,conducting joint conferences and joint monitoring,there is still a long way to go to build a regular collaborative law enforcement mechanism.First of all,the excessive principle and abstractness of the legal provisions make the coordinated law enforcement face numerous obstacles in practice.Only by clarifying and concretizing the provisions of the legal provisions,can the fundamental guidance basis for the coordinated law enforcement be provided.Secondly,for the establishment of inter-provincial law enforcement agencies,the starting point is mostly focused on unexpected environmental pollution events or some special remediation activities,and no stable and fixed agencies have been formed.Leadership of the basin to establish specialized law enforcement agencies,to determine the personnel composition,responsibilities,supervision and management work and clear liability clause in the partnership agreement,the accountability subject,object of accountability,accountability,content and damages shall be detailed provisions,basin specialization leading institutions can have certainty,not become a mere formality.Need to set up a coordination in the central committee at the same time,to guide the area across the provincial government in terms of river basin management,release authority policy and monitor the work of the basin is a specialized law enforcement leadership,to coordinate the deal between the provincial disputes,and provides Suggestions on the development of river basin planning and consulting,to control the global from the general direction,which is a crucial part of the construction of normalized collaborative law enforcement.Even though the cooperation agreement between the provinces have the joint monitoring and information sharing are regulation,but mostly belongs to the principle provision level,not on the scope of information sharing and depth on the construction monitoring technology of refinement,the need to have both a lot of money and also the coordinate cooperation between administrative regions,to break the boundaries of information island.In the process of watershed law enforcement,especially the border area often becomes a gray area that nobody pays attention to because of the disunity of law enforcement standards and regional factors.On the one hand,the unification of law enforcement standards needs to increase the construction of law enforcement teams and improve the professional level of law enforcement officials.On the other hand,economically developed areas also need to give certain ecological compensation to less developed areas,so as to facilitate seamless connection of law enforcement standards.In reality a lot of planning,protocol is set to the social public disclosure of the environmental data and information,but for the specific content of public information,the information publicly available thinning,how the information feedback and so on all have no,only for the public to participate in the one,give full play to the public supervision in the collaborative law enforcement power.Therefore,to form a regular collaborative law enforcement mechanism,it is necessary to uphold the concept of overall governance and comprehensively strengthen legal construction,information monitoring and sharing,accountability,team building,institution establishment and other aspects.
