Research On Project Cost Management In Construction Phase From The Perspective Of Judicial Precedent

In recent years,with China’s socialist modernization into a new era,the rapid development of the construction industry,making the construction industry in China’s economic construction has an important role in promoting.With the increasingly fierce market competition,a series of problems need to be solved,especially the higher requirements for the construction project cost management.How to carry out the standardized management of the project cost in the construction stage to reduce the loss caused by the project disputes has become one of the problems to be solved.Based on the above reasons,this paper starts from the perspective of judicial precedents,takes the project cost management as the breakthrough point,takes the project cost dispute elements in the construction stage as the research object,and summarizes the current situation of project cost management and the common cases of cost dispute factors in the construction stage of construction projects by consulting the literature and collecting the judgment documents published by the people’s court.According to the characteristics of project cost management,the main influencing factors are summarized as the following aspects,namely,the main body of project construction,project construction stage,project contract effectiveness,project cost pricing basis and construction quality.The project cost management in the construction stage is an important part of the construction project management,which directly affects the economic benefits of the construction project.Firstly,we can grasp the key points of project cost disputes from the overall perspective;Secondly,the key factors can be found by calculation and analysis;Thirdly,prevention and control measures can be prepared according to the evaluation of key factors.Secondly,affected by the epidemic situation,this paper selects the case data of 31 provinces and cities in China in 2019 about construction cost disputes,and uses the statistical analysis method of factor analysis to extract three key factors from 15 main factors.According to the characteristics of each factor and their mutual relationship,the three key factors are explained and renamed,They are project payment,project specification and contract terms.Finally,the paper analyzes and summarizes the three key influencing factors,and puts forward the methods and relevant countermeasures to prevent project cost disputes in the construction stage from the perspectives of contract management,project cost settlement and project evidence materials,so as to provide research ideas for construction projects to avoid project cost disputes.
