| The new criminal procedure law added the "technical investigation" section,on the one hand technical investigation is regulated,on the other hand is to better fight crime.However,technical investigation is very secretive,the use of technical investigation of evidence is not very satisfactory.At present,the theoretical study of technical investigation focuses on the regulation guarantee human rights,technical investigation and study of use of evidence in the practice is relatively lacking.Under the new points of technical investigation of evidence examination mode has a direct cross-examination,protect the cross-examination mode,verify the three out of court.Public cross-examination inevitably involves the technical principle and method of detection means,in practice,technical investigation department also could not provide evidence to the court directly.Protect the cross-examination mainly reflected on the protection of relevant personnel identity,single in terms of technical investigation evidence itself,into a very difficult in practice.Theory and practice of most strongly on the court to verify the model,main thought of verification may limit even deprive defendants of licensor and inquiry.After the new points,Wuhu in Anhui province intermediate people’s court,the people’s procuratorate,the public security bureau jointly set up technical investigation evidence review committee,on how to protect human rights protection and technical measure to explore.Through comparative analysis,I want to be able to put forward some advice to the theoretical and practical studies. |
