Study On Compulsory Liability Insurance For Drug Safety

In view of the current large number of drug safety incidents,the victims in our country can only resort to litigation for relief.In many cases of drug safety incidents,especially adverse drug reaction events,drug sellers and manufacturers will refuse to compensate for that are qualified products.At this point,many victims have to embark on a long and costly process(lawyers’ fees,travel expenses,etc.).To make matters worse,many manufacturers and sellers are held liable for drug safety incidents and eventually go bankrupt,leaving many victims without compensation.However,the inclusion of drug safety incidents in compulsory liability insurance would not only prevent sellers and producers from going bankrupt,but enables victims to obtain prompt and comprehensive compensation.Therefore,it is very necessary and reasonable to establish compulsory liability insurance system to solve drug safety incidents.This article will discuss from four parts,the first part from our country typical case,points out our country present medicine safety damage relief system flaw and carries on the analysis to our country related law stipulation,points out the insufficiency.The second part analyzes the implementation of drug safety compulsory liability insurance through other disciplines,and discusses the rationality of drug safety compulsory liability insurance.Chapter three analyzes the relief system of foreign drug safety events,compares the advantages and disadvantages of each system.Then,a drug relief system,compulsory drug liability insurance system,is proposed.The fourth part is about the construction of compulsory drug safety liability insurance,mainly from the definition of drugs and related concepts,the scope of application of compulsory liability insurance for drug safety,the main body of compulsory liability insurance,compensation scope,rates and claims process,especially for the detailed and specific discussion of claims process,hoping to provide effective reference for the establishment of compulsory liability insurance for drug safety in China.
