| As a strategic technology to lead the future of mankind,artificial intelligence(ai)has been increasingly recognized globally for its great potential for technological,industrial and social change.In today’s world economic downturn,artificial intelligence is still hot.It is not only regarded as a new engine of scientific and technological innovation and economic development,but also has risen to the height of national strategy and become a new focus of international strategic competition.In July 2015,the state council issued the guiding opinions on actively promoting the "Internet plus" initiative,which proposed accelerating breakthroughs in core artificial intelligence technologies.In 2017,the state council issued the plan for the development of a new generation of artificial intelligence,which clearly set out the strategic goal of "three steps".By 2030,the theory,technology and application of artificial intelligence will reach the world’s leading level and become the world’s major innovation center of artificial intelligence.While promoting the rapid development of China’s economy and society,artificial intelligence challenges China’s laws in the aspects of legal subject status,legal supervision,ethics and algorithm alienation.We need to keep an eye on the development of artificial intelligence and control the risks and challenges generated by artificial intelligence within a controllable scope through laws.Only in this way can we modernize China’s governance capacity and system and contribute Chinese wisdom and solutions to global governance.Starting from the basic knowledge of artificial intelligence,this paper expounds the concept,characteristics,types and essence of artificial intelligence,and analyzes the important significance of developing artificial intelligence.Then,it expounds the theoretical and practical value of ai legal governance,and analyzes the principles of legal governance.Finally draws on Japan,the United States,South Korea,Russia,the European Union and other countries and international organizations to legal measures of artificial intelligence,combined with the artificial intelligence subject status in law,regulation,ethic,algorithm dissimilation problems,such as the key to solve above problems puts forward the countermeasures to solve these problems,a clear legal object position of artificial intelligence,perfecting the regulation of artificial intelligence,responsibility main body,content,mode,build the ethical norm of artificial intelligence,strengthening the legal governance of artificial intelligence,boosting our country law of artificial intelligence management gradually improve.The wisdom,strategy and path that China has put forward,put into practice and contributed to ai governance have demonstrated the demeanor,bearing and responsibility of a major country,and will surely usher in a new era of global governance. |
