Research On The Arguments Of The Crime Of False Lawsuit

Crimes of false lawsuit has been codified into the Ninth Amendment to Criminal Law which provides legislative foundation for acts of false lawsuit.It has improved the judicial order in certain extent.However,meanings of the clause are multiple and not clear so that there are still some different standards of different judgement.Because of that imperfection,many debates on the crime of false lawsuit has emerged.The first issue to be researched is that what legal interest is about this crimination.Both Judicial order and legal rights of people are the legal interests of the crime of false lawsuit and none of them is priority.The second problem to be resolved is that how to define “fake fact” and “sue a lawsuit” of objective aspect.The last issue is that how to define the accomplished and offence standard.This article would analyse by discussing legal and the whole nature of the crime of false lawsuit.The three issues mentioned in front are the most significant and controversial problems about this crimination and they will be analyzed in detail.
