A Study On The Crime Of Spreading Obscene Articles

The control of obscene articles in China is very strict,especially in the modern society.With the development of Internet technology,the spread of obscene electronic information has also attracted more and more attention.Our country has set up a special office to combat pornography and illegal publications.Conducted a net action to eliminate obscene electronic information and purify the network environment.However,the actual effect is not ideal.Nowadays,obscene information is still flooding the Internet environment,and the more technology is developed,the more its speed and scope of transmission are.It is difficult to control,so controlling the spread of obscene articles and reducing their impact is a reality that needs to be resolved.The crimes of spreading obscene materials in our criminal law mainly include the crimes of spreading pornographic materials for profit and spreading obscene materials.This article will also analyze the related theories and legislative and judicial practices involved in these two crimes.First,divide the obscene articles at the theoretical level,distinguish the concepts of obscene and pornographic,analyze whether the online obscene information should belong to obscene articles,and then organize and analyze the criminal development trend of spreading obscene articles after 2000 in judicial practice;Secondly,this article collects samples of crime cases of spreading obscene articles by random sampling on the Peking University magic weapon website by year,and sorts out a total of 524 judgments as the basis for data analysis,respectively from legal interest research,object identification,behavior research and sentencing research.In terms of combining theories and actual judicial data,the author analyzes the crime of spreading obscene materials,and proposes problems and suggestions for improvement.I hope that this kind of crime can be further improved,which can not only ensure the healthy growth environment of minors,but also not infringe on the legal rights and interests of adults,but also promote the prosperity of China’s cultural industry to a certain extent,which is conducive to the rule of law The completion of society.
