On The Enlightenment Of EU "Digital Single Market Copyright Directive" To China’s Copyright Protection

China’s economy has entered a new normal,and the digital economy is gradually becoming the main engine of the country’s stable economic growth.However,the legal system of copyright protection in China has been difficult to meet the needs of the digital economy era.On March 26,2019,the European Parliament adopted the digital single market Copyright Directive by 348 votes in favor and 274 votes against.The purpose of the digital single market Copyright Directive is to adapt the copyright rules of EU to the changes and development of the digital era,and to realize the good operation and sound development of the copyright market in the future.The directive will be the most significant reform of the EU copyright system in recent years.It also establishes a more equitable copyright framework,which will have a profound impact on the global Internet industry.At the time of the revision of China’s copyright law,this paper will study the EU’s digital single market protection directive,pay attention to a series of measures and institutional innovations taken by the EU in copyright protection,and try to find a new way for China’s copyright protection in combination with the defects of China’s copyright protection,which will be conducive to enriching China’s copyright protection The theoretical construction and practical innovation of the system can better improve the legal system of copyright protection in the digital economy.In the first part of this paper,the author makes a general comment on the EU digital single market Copyright Directive from three aspects: the background,the main content and the promotion of the EU copyright system.This paper analyzes the significant measures taken by the EU digital single market Copyright Directive in reforming the EU copyright legal system.The second part discusses the reference basis of China’s copyright protection to the EU’s digital single market Copyright Directive.It mainly demonstrates the significance of EU’s copyright system to China’s copyright protection from the consistent practices of China’s copyright legislation and the current international environment.The third part studies the specific situation of copyright protection in China,trying to clarify the problems of copyright protection in China.This paper expounds the problems in text and data mining,digital protection of out of print works,and rules of safe harbor.The fourth part refers to the EU’s reform measures in copyright protection,combined with the specific situation of China’s copyright protection in the new era,and puts forward the perfect path for China’s copyright protection.
