| The family is the cell of society,and the harmony of the family is directly related to the harmony of society.Based on this,in order to ensure the harmony of the family,in 2016,China introduced the“Anti-Domestic Violence Law of the People’s Republic of China”on domestic violence,becoming the first law to punish domestic violence.In order to effectively protect the victims of domestic violence,a life safety protection order is included.However,the focus on domestic violence has always been focused on women.It is difficult to protect the rights and interests of minors as victims of domestic violence,and the law does not provide special provisions for the protection system of minors’ personal safety.Coupled with the late start of the personal safety protection order system,some issues regarding the protection of minors’ rights and interests need to be improved: the main manifestations are incomplete types,limited scope of application bodies for the applicants,unclear burden of proof,lack of specialized agencies,and unclear power of law enforcement.Aspects.In comparison,the United States,Japan,and the United Kingdom and other countries have more comprehensive systems for protecting personal safety against minors.The enlightenment for our country lies in the diversity of types of personal safety protection,more reasonable allocation of burden of proof,and a clear division of labor and responsibility for the implementation of subjects.Three aspects.Combining the existing deficiencies in China’s legislation and comparing the system of minors ’personal safety protection orders in developed countries,it is necessary to increase the types of minors’ personal safety protection orders,clarify the subject of application for responsibility,reduce certification standards and increase the number of places for minors.It also clarified the distribution of powers and responsibilities of enforcement agencies,strengthened the application of protection orders for minors’ personal safety,and strengthened the protection of victims of domestic violence. |
