| The right to defense is one of citizens’ basic rights.Lawyer defense,the addition of right to defense,is used to help citizens exercise the right to defense.However,the low rate of criminal defense and low defending quality have been two main dilemma.The Supreme People’s Court and The Ministry of Justice jointly issued Measures for the pilot work to cover all criminal defense cases on October 11,2017,when the work to cover all lawyer’s criminal defense was started in 8 different provinces as pilot work,which has changed the low rate of defense in our country.In order to solve the problem of low defending quality in our country and build the system of effective defense institution,it is urgent to study the effective defense in the background of defense covering all criminal cases reform.Combining with the basic concept of effective defense,in the background of defense of covering all criminal cases,the author analyzed reasons and dilemma of low quality of lawyers’ defense at present and put forward achieving effective defense from several aspects,including building scientific standard of effective defense and relieve institution,improving safeguards system of lawyers in practice,setting up admission,examination and punishment system for defense lawyers and rectifying deviations subjectively. |
