The Reconstruction Of Investor Rights And Interests Protection System In Margin Requirement

Due to the impact of the stock disaster,since 2016,the number of disputes over margin trading and securities transactions between securities companies and investors accepted by Chinese courts has increased,exposing the problem of insufficient protection of investor rights.Previous literature has paid less attention to the issue of investor rights protection in margin financing and short selling,and lacks in-depth research.First,it analyzes the connotation and extension of investor rights and interests in margin financing and securities lending,and examines the alienation of investor rights and interests under the operating model of margin and securities financing;secondly,it analyzes the interest structure and the influencing factors of investor rights and interests in financing and securities lending,and analyzes the legal regulations;Finally,based on certain goals,ideas and legal principles,it puts forward suggestions for optimizing the investor rights protection system in margin trading.Based on the above thinking,the full text is divided into four chapters in addition to the introduction and conclusion:Chapter one,the connotation and extension of investor rights and interests in margin financing and securities lending,this chapter discusses the legal connotation and extension of investor rights and interests;Chapter two,the alienation of investor’s rights and interests under the operating mode of margin financing and securities lending,this chapter analyzes the function of the account and the account,the operation of the system,and the alienation of investors’ rights and interests under the operating mode is examined;Chapter three,the interest structure of the margin financing and securities lending entities and its legal regulation status,this chapter discusses the interest relationship between the financing and securities lending entities and focuses on identifying the impact on investment,the key factors of investors’ rights,and analyze the corresponding legal regulations to find out the deficiencies of legal regulations;Chapter four,the optimization of investor rights protection system in margin financing and securities lending——design based on the concept of equilibrium,based on investor rights,the goal of protection,the concept of balanced protection,and the principles of incentives and personal responsibility,provide specific suggestions for optimizing the investor rights protection system in margin financing and securities lending.The field investigation of the operating conditions of the margin financing and securities lending business of the securities company’s business department,focusing on the protection of investors’ rights and interests,and the application of multi-disciplinary research methods and theories are the innovations of this article.
