Since the founding of New China,from the initial land reform to the current separation of powers,the rural land system has been constantly changing.The reform of the rural land system is dependent on the basic national conditions of social development in China,and focuses on promoting the development of rural agricultural economy and increasing the income of the majority of farmers.The transfer system of rural land management rights is the key to the reform of the separation of powers.This is of great significance to further improve the efficiency of rural land use,develop agricultural economies of scale,and increase farmers’ income.Behind the historical evolution of the rural land circulation system,the rural economic structure has been optimized and the level of development has been further improved.At the same time,as the first basis for reform,the legal system construction is closely followed.Current Situation,Problem.Based on the basic theory of rural land management right transfer,this article analyzes the existing problems of the rural land management right transfer system using legal theory,and then puts forward perfect measures and suggestions.The full text is divided into four parts.The first part elaborates the basic theory of the transfer of land management rights from three aspects: the historical evolution,basic connotation and institutional significance of the rural land system,which provides a basic framework for the improvement of the rural land management rights transfer system.The second part is an empirical analysis of the transfer of rural land management rights,and puts forward the theoretical and pract ical problems of the implementation of the system: there are inadequacies in the connection between the laws and the departmental laws;the transfer market mechanism of intermediary services and regulatory agencies is lacking The lack of supporting mechanisms;and the incomplete protection of the rights and interests of the parties involved in the transfer transaction form a practical obstacle in the transfer of management rights,and indicate the direction for improving the transfer system of rural land management rights.In the third part,through horizontal and vertical comparative analysis of the rural land systems and circulation systems of representative developed and developing countries abroad,the system design is worth learning from.The basis for a better land circulation level in each country is comprehensive and meticulous.Conflict,complete legal system,government service market concept,multi-party coordinated supervision,moderate intervention system,and multiple and efficient dispute resolution mechanisms.The fourth part,according to the problems analyzed in this article,adheres to the principle of problem-oriented and effect-oriented,and puts forward relevant suggestions for improving the rural land management right transfer system: moderately refer to the design of the land transfer legal system in various countries,and put forward corresponding improvement paths for specific system issues;Adhere to the principle of appropriate government intervention,strengthen the service concept,and improve the circulation market mechanism by forming a new evaluation system and improving the market platform system;by adding an insurance system to compensate for the lack of rural social security,optimizing financial support and dispute mechanisms to enrich the supporting system;Improve the risk control capabilities in the early,middle and later stages of circulation to achieve the protection of the parties to the circulation transaction.Furthermore,it has achieved a number of comprehensive paths including legal regulation,government guidance,and multi-party supervision as a whole to promote the in-depth reform of the separation of powers and promote new development of the rural economy.
