Study On The System Of International Commercial Court In China Under The Background Of The Belt And Road

The proposition of the “Belt and Road” policy is not only closely linked to China ’s economy,but also affects the development of various countries and even the global economy.Since the introduction of the “Belt and Road” initiative,it has brought huge wealth and benefits to the countries along the route.Differences in geography,humanities,cultural background,trading habits and other aspects,contradictions between countries have become the inducement factors for international commercial disputes.Against the background of the increasing number of cross-border commercial disputes,in order to respond to international trade disputes in China,in 2018 The plan to establish an international commercial tribunal in 2015 was officially launched,with international commercial tribunals set up in Shenzhen and Xi’an respectively.The “Belt and Road” international commercial dispute mechanism is a relatively new topic.Due to the short implementation time,domestic studies on international commercial dispute settlement mechanisms are still in the preliminary stage.This article mainly discusses from three parts: The first part is that introduces the relationship between China ’s “Belt and Road” construction and international commercial disputes,as well as its characteristics.It also introduces the institutional content of China ’s international commercial court.The second part analyzes the current status of the operation of China ’s international commercial court and finds its existence The third part is mainly based on the analysis of the International Commercial Tribunal under the“Belt and Road” international commercial dispute settlement mechanism,and addresses the deficiencies in China’s international commercial court system.It puts forward specific improvement measures and proposes innovative ideas for the various restrictions of China’s international commercial courts.It is hoped that through a series of reform measures,it will further innovate and improve the international commercial dispute resolution mechanism so that our international commercial courts can Economic and trade Stronger support for justice,so that "all the way along the" initiative to be more long-term implementation of it,for our international commercial court to establish greater right to speak basis in international status,global economic community of destiny.
