| Minors are the sustenance of hundreds of millions of families and the hope of the country and the nation.With the rapid development of the economy and society,influenced by various social trends of thought brought by informatization and network to minors,the illegal crimes of juveniles are increasingly prominent.Strengthening the judicial protection of juveniles is not only the common responsibility of the whole society,but also an important responsibility of procuratorial organs.At present,the judicial reform is in full swing.The reform of juvenile criminal prosecution is an important part of China’s juvenile judicial reform.The reform of juvenile criminal prosecution needs to follow the judicial concepts of "the principle of the best interests of children" and "the principle of parental rights of the state" to accelerate the standardization of juvenile criminal prosecution.Therefore,continuously improve the juvenile criminal procuratorial work mechanism with Chinese characteristics,to explore the current reform of the judicial system under the background of the juvenile criminal procuratorial organization,working groups and working mode,procuratorial functions of minors,and minors procuratorial evaluation mechanism reform path has very important practical significance and theoretical value.This article consists of four parts.The first part briefly introduces the basic issues of juvenile criminal procuratorial work,such as the concept of juvenile criminal procuratorial work,the significance of juvenile criminal procuratorial work and the principle of juvenile criminal procuratorial work.The second part for our country juvenile criminal procuratorial work status,including the juvenile criminal procuratorial work development and legislative regulations,v.case surveillance integration mode,minor criminal cases dealt with characteristics and attach conditions not to prosecute,the third part puts forward many problems exist in the process of judicial practice,such as juvenile criminal prosecution team construction lack of professionalism,high rate of custody minor crime arrested and social survey system is not perfect.The fourth part puts forward some Suggestions on how to improve the criminal procuratorial work of minors in our country.Combined with the deficiencies in the current judicial practice of criminal procuratorial work,it is suggested to explore the establishment of juvenile procuratorate,the establishment of juvenile criminal arrest evaluation mechanism and the establishment of a sound social investigation report system.Hope to the current juvenile justice system reform smoothly forward to provide useful thinking. |
