Research On Legal Issues Of Social Network Account Transfer

As the network is more and more popularized nowadays,social network accounts such as We Chat accounts and QQ accounts become increasingly important in people’s life,which are main social communication tools.These social network accounts,if not properly protected,may cause many problems,among which account transfer is one of the major problems.This paper analyzes the connotation of social network accounts,identifies the property rights of the accounts,and summarizes the legal relationship of account transfer.In particular,it focuses on the ownership of social network accounts.The author points out five problems that social network accounts will face in the process of transfer,which are,lack of legal basis,actual delivery difficulty,conflicts of user privacy right protection,third-party reliance interest protection problems,and litigation dispute resolution problems.Aimed at solving these problems,the author puts forward his own suggestions based on the research of domestic and foreign practical experience.He believes that it is a priority to formulate legal basis to fill the gap in laws,a key to clarify the rights and obligations of Internet service providers,and a guarantee to establish a safe and efficient new order of account transfer.In view of the specific problems in the process of account transfer,some technical measures should be taken,such as using electronic authentication technology to ensure transaction security,using specific data clearing technology to protect user privacy security,using the reminder function of right change to protect the reliance interests of the third party,etc.While social network account transfer may come across various problems in practice,we should remain a supporting attitude towards it,as the transfer of social network accounts are feasible and necessary.Moreover,the transfer of social network accounts is a kind of private behavior,which does not violate the mandatory provisions of the law.If it is regulated and guided properly,it will not harm any social interests.On the contrary,it can stimulate people’s enthusiasm to operate online accounts and promote the prosperity of the Internet application market.
