Research On The Epidemiology Causality Theory In The Criminal Law

The existence of conditional relationship between behavior and result is the premise of causal relationship in criminal law.From the point of view of the condition theory,there is only a conditional relationship between action and result when they have a relationship about if there is no former,there is no latter.This relationship is the one that has been proved by science.Otherwise,we can not figure out former can trigger latter.However,when there is a situation that scientific laws cannot explain why and how the random results caused by the behavior can lead to the occurrence of the results,it is difficult to prove the existence of a conditional relationship between the action and result by using known scientific laws,and it is wrong to judge the causal relationship between the action and result by continuing to use the conditional theory.Different from the conditional theory,epidemiology causality theory judge the relationship between action and result by epidemiological investigation.It is believed that there is a causal relationship between the behavior and the result when the effect of the behavior is more obvious and the probability of the result is greater.So epidemiology causality theory can remedy the drawback of the condition theory.It mean that epidemiology causality is equal to conditional relationship that is an undoubted relationship.The different about them is just that conditional relationship utilize backward induction to find the truth,but epidemiology causality utilize epidemiological investigation to find the truth.We don’t have public hazards criminal theory and Gefahrdungshaftung theoty in China,so we should use random result to define the epidemiology causality theory’s range of application is a sensible means.We can find epidemiological investigation in our criminal pratice,but under the circumstance of lack of relative ratio,we need to transplant it in our country to direct us judging epidemiology causality.The Epidemiology Causality can be confirmed only when there is a correlation between the behavior and the result reach to a certain extent.
