Research On Civil Law Issuesin Big Data Transaction

The emergence of big data industry stems from the popularization of new generation of information technology innovation and application,such as computing and mobile internet.Up to now,the scale of Chinese network users ranks first in the world,with rich data resources and application market advantages.If we can take the lead in the R&D and application of big data technology,we can continuously promote the vigorous development of innovation enterprises and application of the Internet.Big data transaction is the act of buying and selling the rights and interests of data.A good data trading environment is a prerequisite for the full realization of data value.However,at present,the key problems such as the ownership of data information,data collection and processing,data transaction supervision,and others,which lack effective measures in legislation and practice need to be solved urgently.By studying the specific behavior of data trading,this paper combs the current situation and related defects of China’s big data trading market,learns from the legislation of European and American countries,puts forward reasonable solutions,and analyses and explores the improvement system of China’s big data industry.We should clarify the responsibilities of data ownership and transaction subjects,improve the relevant rules of sensitive data cleaning and data transaction supervision mechanism,etc.
