Research On The Protection Of Linguistic Rights Of Minorities From The Perspective Of International Human Rights Law

Linguistic rights are the rights that everyone can claim.However,for a small number of disadvantaged groups,their linguistic rights have received the attention and protection of international human rights law.The recognition and protection of minority linguistic rights is an important part of international human rights protection.The United Nations and regional organizations have successively issued international conventions and declarations for the protection of minority linguistic rights.The basic of international law,but the minority linguistic rights have not yet formed a consensus theoretical system.This article will try to analyze and explain the principles of minority linguistic rights through the analysis of the concepts of minority people and ethnic minorities,dialects and language,and the basic knowledge of international human rights law and jurisprudence.The subject of rights,the objects of rights protection,and the nature of rights,to further clarify the legal elements of minority linguistic rights and improve the theoretical basis for the application of minority language rights.China has faced the issue of ratification after signing the UN Covenant on Civil and Political Rights.Article 27 of the Convention refers to minorities slightly different from our minorities,and there is a problem of coordinating the relationship between international law and domestic law.However,domestic academic circles have always placed emphasis on the protection of minority linguistic rights from the perspective of ecological language and endangered language rescue and ethnic policy research from the perspective of ethnology.Few studies on minority linguistic rights from the perspective of international human rights law,In addition,there is still a problem of insufficient legislation to protect the linguistic rights of ethnic minorities in China.This article compares the protection of minority linguistic rights in different fields of society with the analysis of global and regional international human rights law documents and China’s legal protection measures for minority linguistic rights,and tries to compare the concept of minority linguistic rights.Introduce the perspective of domestic minority linguistic rights protection,analyze Chinese shortcomings in protecting minority linguistic rights from the perspective of international human rights law,and propose feasible suggestions to adjust domestic and international laws and regulations for China Legislation to protect the linguistic rights of minority people provides a reference.
