| All countries in the world have a copyright collective management system,but each country has different ways of presenting,the Nordic countries,the United Kingdom,Russia has relatively mature copyright extended collective management system.The copyright extended collective management system is a new intellectual property legal system which appears which the increase of the number of works and the wide use of new media.The copyright extended collective management system can better respond to the social demand,and can better solve the problems such as the stagnation of a large number of works,the unprotected status of non-member copyright owners,the universal infringement of copyright and adjacent rights.As a result,more and more countries are considering transplanting the legal system,but the national conditions,especially the origins of the legal system,of many countries are quite different from those of the Nordic countries.Russia has transplanted extensibility of copyright collective management system of rich experience,has experienced the baptism of the different way of legislation,the relevant legal system has been basically adapt to the country’s cultural background and legal system,however,Russia’s extensibility of copyright collective management system still exists many legal defects and blank,the main gaps to extend copyright collective management organization of the responsibility of the legal status,organization activity and supervision on the related legal norms.The paper aims to explain the status quo of Russian copyright extended collective management system,discusses the scheme of improving Russian copyright extended collective management system,and puts forward some Suggestions for China to establish the copyright extended collective management system.This paper is divided into three parts: introduction,text and conclusion,among which the text is divided into four chapters.The first chapter explains the connotation and legal characteristics of copyright extended collective management.Through the analysis of the connotation and legal characteristics of the copyright extended collective management and the source of the “disposition” right of the management organization,the author concludes the disadvantages,advantages and potential benefits of the copyright extended collective management system.The second chapter discusses the history and present situation of Russian copyright extended collective management system.This paper analyzes the characteristics of the establishment and operation of the copyright extended collective management organizationin Russia and the safeguard measures of the state.The third chapter analyzes the problems existing in Russia copyright extended collective management system.Based on the analysis of the legislative characteristics of the Russian copyright extended collective management system in chapter two,this paper discusses the effectiveness of the system,and explores the compatibility between the legislation and the actual cases based on the existing Russian copyright extended collective management laws and regulation and legal practices.The fourth chapter puts forward Suggestions on improving the Russian copyright extended collective management system.Based on the above research,this paper proposes a targeted improvement plan for the problem of copyright extended collective management system in Russia,and analyzes and discusses the possibility of using the legislative experience of other countries to solve related problems in Russia.In addition,this paper also puts forward an optimization plan for Russian copyright extended collective management system under the challenge of modern science and technology,which uses the concepts of artificial intelligence,data block chain technology and creative Commons license. |
