Research On Electronic Data Based On Blockchain Storage Technology

In June 2018,the hangzhou Internet court adopted the electronic data certified by the block chain technology for the first time in the public trial of a dispute case involving the infringement of the right to network dissemination of works information,and confirmed the legal effect and judgment criteria of the evidence.Subsequently,the supreme people’s court carried out the pilot work of the Internet court,and issued the provisions on several issues concerning the trial of cases by the Internet court,which gave the legal effect to the tamper-proof technology of electronic data,thus providing an institutional guarantee for the application of the block chain technology in the field of electronic data storage.With the extensive application of electronic data in judicial practice,people’s demand for electronic data storage has increased significantly.No matter how the electronic data is generated and extracted,it is easy to be lost and tampered with,which aggravates the technical difficulty of electronic data review and judgment.However,the block chain technology,with its unique characteristics of decentralized storage,tampering and chain data structure,is naturally consistent with the requirements of electronic data storage.Starting from the current situation of electronic data storage and the development trend of block chain technology,this paper provides some feasible solutions for the block chain technology to solve the practical problems in the field of electronic data storage.In this paper,literature review,judicial documents retrieval,comparative analysis,sum up the method of block chain exists electronic data related laws problem is studied,through contrast analysis of block chain exists with the traditional electronic data of the relation and distinction between censorship rules of evidence,analysis of block chain exists electronic data in the process of judicial review of the evidence that method.Firstly,starting from the risks and challenges faced by the judicial application of electronic data storage,the block chain storage technology is introduced,and the operation process of block chain storage and the necessary conditions for security storage of third-party storage platform are sorted out from the relevant theories of block chain such as hash value check,peer-to-peer network,consensus mechanism and other technologies.Secondly,the paper compares the connection and difference between the traditional storage method and the electronic data of the block chain storage,analyzes the identification method of the evidence qualification of the block chain storage,and puts forward that based on the dual carrier attributes of the electronic data,both formal authentication and substantive authentication are considered.Finally,the paper makes an exploratory summary of the electronic data acceptance rules of blockchain storage,and expounds the institutional value of the combination of blockchain and electronic data storage.
