A Study On The Protection Of The Rights And Interests Of Retired Soldiers In China

With the need of building a strong army,more and more attention has been paid to the protection of the rights and interests of ex servicemen.In order to effectively protect the rights and interests of ex servicemen,the state has established the Department of ex servicemen affairs,which also reflects the great importance attached by the state to the work of ex servicemen.At present,there are a large number of retired soldiers in our country.If their rights and interests are not reasonably protected and there is no reasonable way to safeguard their rights,they will have bad emotions and make extreme behaviors,such as collective petition.This will cause social instability and is not conducive to military construction and national security.Therefore,how to effectively protect the rights and interests of veterans is a problem that needs great attention at present.The research on the protection of the rights and interests of veterans meets the requirements of social development.This paper analyzes the concept and scope of the rights and interests of the veterans in China,clarifies the concept and scope of "retired" and "veterans",probes into the scope of the rights and interests of the veterans,and clarifies the object and scope of this study.To explore the necessity and value of the protection of the rights and interests of the veterans,the requirements and principles of the Constitution and laws determine that the rights and interests of the veterans must be protected,and the protection of the rights and interests of the veterans is an inevitable requirement to compensate the sacrifices and contributions made by the veterans.Because the servicemen have fulfilled their obligations of military service,undertaken more state obligations and made more sacrifices,the rights and interests of the servicemen that have been impaired during their service still need to be restored after their retirement,and they need special legal protection.Through the analysis of the current situation of legislation and law enforcement of the protection of the rights and interests of the veterans in China,we can find out the problems.The legislation of this security system is lack of science,and the provisions on the material assistance right,the right to education and the right to employment of the veterans are not perfect.The legal relief channel for the rights and interests of the ex servicemen is not clear.To study and draw lessons from foreign practices will give some enlightenment to the improvement of the rights and interests protection system of our country’s veterans.As a military power,the United States has a very systematic protection of the rights and interests of ex servicemen.It has a sound legal system and high welfare treatment,especially in the aspect of education funding,which is worthy of our reference.Our country should establish a complete legal system to protect the rights and interests of ex servicemen,clarify the reliefchannels of ex servicemen,strengthen the supervision of the organs,and protect the rights and interests of ex servicemen from all aspects.
