Research On Tort Liability Of Intelligent Robot

Artificial intelligence technology is developing rapidly.Intelligent robots,including autonomous vehicles,not only bring opportunities,but also challenge the traditional tort liability system.As for the challenge brought by intelligent robot to the traditional tort liability system,this paper puts forward some views and countermeasures.The first part is the introduction,which includes the background and purpose of the research of this paper,the analysis of the status quo of the research on tort liability of intelligent robots,the summary of the research methods and the innovation points and shortcomings of the research.The second part,an overview of intelligent robot,defines the concepts of artificial intelligence,intelligent robot and autonomous vehicle.After discussion and analysis of the legal status of intelligent robots at home and abroad and the theoretical basis of legal personality,the conclusion is drawn that intelligent robots do not have legal personality.The third part,the challenge of intelligent robot to the traditional tort liability system,analyzes the problems brought by intelligent robot,such as the responsibility subject,subjective fault,imputation principle,and the difficulty to grasp the balance between tort risk and economic value.This part also describes the attempts of the United States,the European Union and China to meet the challenges.The fourth part,the construction of tort liability system of intelligent robot,tries to use product liability as the main framework.This part determines the subject of liability and the principle of different imputation,and interprets and applies the legal provisions under the existing tort liability system.This part clarifies the principle of risk guarantee mechanism and shares risks and responsibilities and compensates for losses through compulsory insurance,compensation fund and safety standard of intelligent robot.The fifth part,the conclusion,briefly summarizes the content of this paper,and shows the attitude towards the development of intelligent robots to be inclusive and supervised at the same time,and expresses the expectation that intelligent robots can provide better services for human beings.
