Research On The Legal Issues Of Medical Waste Management In Public Health Emergencies

In public health emergencies,the concept of medical waste is no longer limited to medical institutions and medical processes,and medical waste may also be generated in non-medical institutions and non-medical processes.Therefore,it has special attributes such as the emergency of management means,the complexity of waste sources and the extensiveness of involved subjects.Therefore,to realize the rule of law of medical waste management in public health emergencies is not only necessary to protect public health,but also to ensure ecological safety,and to realize the rule of law in emergency.Although the legal system of medical waste management has been formed in China,public health emergencies have put forward higher requirements for the management of medical waste.Especially in the process of COVID-19 epidemic prevention and control,it is revealed that the legal system of medical waste management in public health emergencies in China still needs to be improved.Through sorting out the current legislative situation of medical waste management in China,it can be seen that in the process of fighting against public health emergencies such as COVID-19,the current legal provisions of medical waste management in China lack of special legislation,the emergency management system is incomplete,the treatment process is not standardized,and the relevant safeguard measures are not complete.Among them,the more prominent is the lack of special legislation for medical waste management under public health emergencies;In the process of medical waste disposal,the temporary storage and disposal environment is lack of legal norms under emergency conditions or the legal norms are too general.In view of the above problems,put forward the following law to perfect the idea.First,special legislation should be enacted to remedy the legislative shortcomings of medical waste management in the event of public health emergencies.Secondly,we should improve the management system,clarify the responsibilities of relevant subjects,improve the coordination and cooperation supervision mechanism,and strengthen supervision.Thirdly,the collection,temporary storage,transport,disposal and other related treatment processes of medical waste in the abnormal handling of public health emergencies should be regulated by law.In terms of collection,the special collection system set up by non-medical institutions and the temporary storage link not involved in the past should be standardized.In order to strictly manage the transshipment link,it is suggested to set up the system of transshipment in special area and special line.In order to strengthen the management of disposal links,it is proposed to clarify the environmental assessment requirements for new disposal projects and establish the system of emergency disposal resources list.Finally,in order to improve the relevant legal safeguard measures,the establishment of a unified complaint and report platform,reasonable regulation of the burden of costs and other measures to standardize,so as to provide a legal basis for the improvement of China’s medical waste management system.
