A Study On The Problem Of Grassroots Overstepping Petitions Under The Background Of Territorial Management

At present,our society has entered the transition period,with serious interest differentiation,frequent conflicts and serious threats to social stability.Therefore,the state repeatedly emphasizes the implementation of the new era "Fengqiao Experience" in which "small things do not leave villages,big events cannot be out of town,contradictions cannot be handed over",improve the governance system and governance ability of the grass-roots level,and effectively improve the effectiveness of the grass-roots conflict management.As a mechanism of resolving conflicts with Chinese characteristics,petition system is a "safety valve" in social development,and it bears the responsibility of dredging social conflicts and preventing social conflicts.It plays an important role in releasing social discontent and maintaining social harmony and stability.In 2005,the regulations on letters and visits revised the principle of petition work to "territorial management,hierarchical responsibility,who is in charge and who is responsible".The meaning of the principle is to clarify the responsible subject of petition,strengthen the implementation of the responsibility of petition,improve the quality and effectiveness of the management of the basic level complaint contradiction,and truly solve the complaint contradiction at the grass-roots level,resolve it at the source and avoid layer-by-layer communication.However,due to the deviation of the management principle of the petition territory in the implementation process,the main body of the responsibility of petition and petition has been transferred to the responsibility,and the prevention and control of the source of the complaint contradiction is not effective.Many petition problems have not been resolved reasonably in the basic mediation field,and they become higher level petitions.Therefore,this paper chooses Z District of Shanxi Province as an example,starting from the principle of territorial management of petition,explores the reasons for the ineffective mediation of petition contradictions at the grassroots level.It is found that under the territorial management of petition,the reasons for the leapfrog petition include: too wide acceptance scope of petition departments,unequal rights and responsibilities at the grassroots level,poor coordination of responsible departments,lack of effective means to restrict the petitioners’ leapfrog petition,insufficient performance of community autonomous organizations,lack of legal awareness of the petitioners,and psychological deviation.At the same time,combined with the practice of territorial management of petition in Z District,the paper further puts forward some suggestions to strengthen the territorial management of petition and crack the grassroots petition: improving the classified governance mechanism according to law,promoting the matching of power and responsibility of grassroots government,optimizing the petition assessment mechanism,establishing the mechanism of departmental linkage and regional cooperation,improving the early warning mechanism of contradiction investigation,strengthening the construction of petition team,and improving the level by level of the masses The consciousness of appealing for help and safeguarding rights according to law.Based on the research of grassroots petition problem under the background of territorial management,this paper aims to provide feasible suggestions for solving the implementation error of the principle of territorial management of petition,effectively resolving the problem of petition,and then provide reference for promoting the reform of petition system,improving the governance efficiency of social contradictions,and improving the grassroots social governance ability and governance system.
