Under the background of the rapid development of Internet technology,network short video leads a new audio-visual revolution and forms a huge network short video market,with its stronger resource and capacity advantages than traditional media and the guidance of 5G and big data technologies,breaking the limitations of time,region and crowd.But at the same time,along with the increasing mass short video and the expanding scale of the short video industry,there have also appeared a lot of industry chaos,exposing the legal loopholes and lack of supervision in the development process of the network short video.The healthy development of network short video is inseparable from the regulation of law and the supervision of administrative departments.At present,the legal governance of network society in China has achieved certain results,and gradually established an appropriate regulatory system.However,there are still a series of problems in the field of network short video,such as incomplete legislation,immature protection mechanism for minors,lax subject responsibility,unclear supervision subject responsibility and so on.The development of network video short is a large advancement of the network audio and video,but also brings a series of challenges at the same time,in the face of network governance problems appeared in the process of short video development,we should calm down to think: on the one hand,to perfect legislation of network video short update the legislative concept,innovation governance principles,establish special network short video management regulations,to lead the management of short video of the rule of law and development;On the other hand,within the framework of the rule of law,we should strengthen government supervision and enrich internal and external supervision channels.Only under the system of network short video legal governance measures,we can build a green and healthy environment for the development of network short video.From the purpose of this paper is to clarify the definition of a short video,network features and advantages of short video,using literature research,historical study and comparative research and other research methods,discussed and summarized the current short video network face legal problems in the process of governance,in order to induce effective network short video legal governance measures.This paper is divided into six chapters.The first chapter is introduction.This chapter introduces the significance,research methods and innovation of the topic.The research believes that the network short video,as a new and booming industry,has a great influence,and it is imperative to study and regulate it.The second chapter is an overview of network short video.This chapter defines the definition of network short video,summarizes the characteristics of network short video,that is,high complexity,cross time and space,high mobility and concealment,analyzes the unique advantages of network short video compared with traditional audio-visual,and also summarizes and analyzes the typical illegal types of network short video.The third chapter,the necessity and principle of network short video legal governance.This chapter from the protection of the legitimate rights and interests of short video users,promote the healthy development of short video network platform,to achieve effective supervision of the regulatory sector to demonstrate the necessity of legal governance of short video network.This paper puts forward three principles that should be adhered to in the legal governance of network short video,namely,the limited governance principle,the cooperative governance principle and the rule of law.Chapter four,the extraterritorial network short video legal governance.Combing the legal governance of short video on the Internet in the United States,the European Union and other foreign countries,this paper summarizes the legal countermeasures which can be transformed into the short video governance in our country,such as the rule of three strikes and out,the network security protection of minors,the copyright filtering mechanism and the network illegal filtering system.The fifth chapter,our country network short video legal governance existence question.The legal problems of network short video in China mainly include legislation and legal supervision.Through sorting out and analyzing these problems,it is pointed out that there are still big loopholes and defects in the legal governance of network short video in our country.The sixth chapter,this part mainly aims at the problems existing in the current legal governance of short video on the Internet in China in Chapter 5,combined with the overseas legal governance of short video on the Internet,in this paper,a series of legal measures are put forward to improve the legislation of network short video,optimize the supervision of network short video and promote the autonomy of network short video industry.
