Research On The Legal Person System Of Technology And Innovation Support Center(TISC) In China

Technology and Innovation Support Center(TISC)is a project under the jurisdiction of the world intellectual property organization.In recent years,TISC has developed rapidly at home and abroad.There are 80 countries with TISC in the world,and there are 1021 TISC institutions in the world.TISC construction in China is also in full swing.Since the first batch of TISC pilot construction in 2018,TISC has been developing rapidly.So far,China has approved four batches of 102 TISC contractors,which are distributed in 31 provincial administrative units.However,there are also many legal problems in the high-speed development of TISC,such as unclear legal position,unclear attribute,property confusion,imperfect internal system and so on.This paper attempts to analyze some problems encountered in the development of TISC with simple knowledge,and provide some basic suggestions,so as to contribute to the better development of TISC in China and promote the construction of an innovative country in China.This paper is divided into five chapters,the specific content is summarized as follows.The first chapter first summarizes the research background and significance,then briefly describes the research content and research methods,and then collates and analyzes the literature review of TISC legal person system at home and abroad.Finally,it introduces the technical route of this paper,and briefly summarizes the possible innovations and shortcomings of this paper.The second chapter firstly defines the concepts of TISC proximity:"social service","social service organization" and "intellectual property social service organization",and then analyzes the basic characteristics of TISC in detail,including sociality,service,diversity,professionalism and non-profit.Finally,it briefly introduces the basic definition,basic structure,basic classification and basic system of legal person,Establish a theoretical framework.The third chapter mainly introduces the current development situation and existing problems of TISC legal person system in China.Firstly,it briefly introduces the development process of TISC in China,and clarifies the origin and development of TISC in China.Then it focuses on the six prominent problems in the current TISC legal person system,such as uncertain legal status,unclear legal purpose,lack of internal legal norms,imperfect property system,unclear organization and imperfect evaluation system.The fourth chapter is to improve the legal person system of TISC in China.In view of the six prominent problems encountered in the development of TISC in China,this paper puts forward six specific suggestions for improvement:accurately defining the legal status,establishing a clear legal purpose,establishing internal legal norms,constructing and improving the property system,constructing a clear organizational structure and building a scientific evaluation system.The fifth chapter is a brief summary of this paper,and a vision of the future development of TISC.
