Study On Personal Information Protection Under The Background Of Real-name System In Express Industry

The rapid development of the express industry has brought new and enormous challenges to the personal information security,especially after the implementation of the real-name system in express industry.The personal information security is not only threatened by the illegal disclosure from individuals for profit,but also the random infringement of the public power organs for uploading users’ personal information in express industry to the database held by the public security organs.But there still exists many issues in personal information protection in China.The personal information security is not only not protected properly,but there are also no effective relief measures after citizens’ rights are infringed.Therefore,it is urgent and necessary to perfect the personal information protection system,which is not only related to the vital interests of every citizen,but also to the healthy and benign development of the information industry and even the security of the country in the information field.This paper mainly discusses the security of citizens’ personal information from the following four parts.Part Ⅰ is the introduction of this paper,including the study background,study significance and study methods of this paper.Part Ⅱ is s an overview of personal information under the background of express real-name system.This paper firstly discusses the different definitions of personal information in different countries,then introduces the views on theoretical personal information in China,and explains the related issues of personal information in express delivery.Then this paper introduces the characteristics of personal information,then discusses the nature of the right of personal information from different academic theories,and finally discusses the legitimacy of the right of personal information written into the Constitution.Part Ⅲ mainly discusses the current situation of the personal information protection system in China and the existing deficiencies,and makes a further analysis,mainly including that there is no direct basis for the protection of personal information right in the Constitution,legislation focus on regulating individuals,ignoring the public power organs,supplemental measures in departmental laws are not perfect,and the constitutional interpretation system is difficult to be effectively implemented and etc.Part IV,based on the above content and analysis of foreign mature experience,puts forward the path to improve our personal information protection system.The purpose of protecting the personal information security of citizens can be achieved through the improvement of the legal system and industry association and strengthening the industry self-discipline of enterprises.
