Study On The Advantages And Disadvantages Of Public Opinion Influencing Criminal Judicial Activities

In recent years,with the enhancement of citizens’ awareness of the rule of law,as well as the timeliness of information brought by the Internet and the convenience of citizens’ participation in public case discussion,citizens can quickly express their views to the outside world and begin to comment on cases and the handling of criminal cases by judicial organs with their own simple values.From the distant Zhang Jinzhu case to Deng Yujiao case to Zhao Chunhua case,to Xu Ting case,to the recent Yu Huan case and so on,the public opinion has a great impact on the outcome of the judgment of these cases.It is undeniable that the influence of public opinion on criminal justice activities is a feature of China’s criminal justice in recent years.The influence of public opinion on criminal judicial activities has advantages and disadvantages.This thesis uses case analysis method and literature research method to demonstrate the advantages and disadvantages of the influence of public opinion on criminal judicial activities.The advantage of the influence of public opinion on judicial activities is that public opinion helps to supervise judicial rights,improve judicial credibility,avoid the mechanical application of the wind by judicial personnel,help to reduce the pressure on the court,and promote the process of rectifying unjust,false and erroneous cases.In this thesis,the author puts forward the affirmation and demonstration of the role of public opinion in promoting the process of rectifying unjust,false and erroneous cases,and discusses that public opinion also needs to pay attention to the implementation stage.This is the innovation of the article.But at the same time,the disadvantages caused by the influence of public opinion on criminal judicial activities can not be ignored.It affects the independent judgment of judicial organs,reduces the efficiency of criminal justice,hinders the justice of judicial procedures,diminishes the authority of the judiciary,and reduces the efficiency of criminal justice.For extending the positive factors of public opinion affect criminal justice activities,as far as possible to reduce the negative factors,this thesis puts forward the dialectical treat and handle public opinion in criminal justice activities,combined with China’s national conditions,put forward positive interaction rules,public opinion and criminal justice activities in public opinion intervention time,public opinion to participate in a way,and put forward to strengthen the judge accomplishment,Draw lessons from foreign newspapers,networks and other media to the judicial activities report regulation countermeasures.
