Research On Tort Liability Of Artificial Intelligence Vehicle

The emergence of artificial intelligent cars is of great help to improve our living efficiency and reduce our driving burden.However,it can not be ignored that it also brings many impacts and challenges to the current legal system.If an AI car causes a traffic accident on the road,it is difficult for us to solve the subsequent problems such as the distribution of accident liability and damage compensation directly according to the existing legal system.In this way,it will not only deter the consumers who originally have the purchase demand and desire,but also hinder the innovation and development pace of the intelligent vehicle industry to a certain extent.This paper focuses on the accident cases caused by artificial intelligence vehicles and the subsequent treatment.Through the analysis and research of the current legislation and practice at home and abroad,it finds out the reasonable and feasible countermeasures in line with China’s national conditions.In addition,it also puts forward some perfect suggestions and feasible supporting measures.The introduction part of this paper mainly describes the research background,research significance and current situation of artificial intelligence vehicle tort liability at the current stage,and also briefly introduces the analysis and research methods adopted in this paper.The main body of the article is divided into four chapters:The first chapter mainly focuses on the development status of artificial intelligence vehicle,mainly elaborates its concept,classification and standards,as well as its advantages and defects.The second chapter analyzes the legislative measures taken by countries outside the region(the United States,Germany and Japan)for intelligent vehicles to find the countermeasures of China.The third chapter mainly elaborates the legal liability challenges faced by AI vehicles,namely whether the tort of traffic accident can be solved by using the current tort liability system.Respectively from motor vehicle traffic accident tort liability,product liability and other two Angle analysis,in detail elaborated the system for traditional tort liability in determining the smart car tort liability,and principles of imputation of liability subject deficiency,it is concluded that current is not enough to directly apply the traditional tort liability system to solve the problems of the smart car tort liability.From the perspective of the plight of product liabilitystandard application,this paper analyzes the differences and advantages anddisadvantages among national industry standard,consumer expectation standard and risk utility standard,and further leads to the following.The fourth chapter mainly discusses the improvement of the artificial intelligence vehicle tort liability system in China at the present stage.Firstly,it analyzes the systems that may be applied by analogy in the field of civil law tort.Secondly,it points out that the traditional tort law should make corresponding adjustments in the principle and rules of the determination of liability in order to adapt to the diversified tort liability.Finally,it puts forward some suggestions on the establishment of supporting measures for artificial intelligence vehicle tort liability.
