| In the past 30 years,with the progress of social economy,my country’s banking industry has also entered the fast lane of development.According to statistics,the total assets of my country’s financial industry reached 318.69 trillion yuan at the end of 2019,of which the banking industry accounted for nearly 91%.With the development of the banking industry,the types of banking services and products have become more abundant,effectively satisfying consumers’ needs for investment and financing,savings,and wealth management.But at the same time,consumer infringement disputes in the banking industry have repeatedly appeared in the newspapers.Disorders such as deposit change insurance,flying bills,interest disputes,and forced sales have occurred from time to time,and consumers’ legitimate rights and interests have been threatened.The contradiction between banking institutions and consumers has become increasingly prominent,and even triggered mass incidents,posing a certain degree of threat to social stability.The report of the 19 th National Congress of the Communist Party of China pointed out that in order to effectively prevent and resolve major risks,risks in the financial sector are particularly worthy of attention and need to be strictly prevented.This is of great significance to maintaining social stability.Therefore,it is necessary to conduct investigations and studies on related issues.In April 2018,the State Council established the China Banking and Insurance Regulatory Commission(CBIRC,hereinafter referred to as the "CBIRC")during the institutional reform,which marked the official start of the nationwide reform of the organization of financial regulatory agencies.In December 2018,the Huangshi Banking and Insurance Regulatory Bureau was established on the basis of the original Huangshi Banking Regulatory Bureau.After the reform,the newly established Huangshi Banking Regulatory Bureau continued to carry out relevant work within the framework of the former Huangshi Banking Regulatory Bureau’s consumer rights protection working mechanism.From the perspective of the supervisory authority,this article selects the consumer protection mechanism of the banking industry as the research entry point.Based on the research and analysis of relevant domestic and foreign documents,this article seeks to find a research vacuum zone,and then finds a breakthrough in this research.Using the method of case study,taking Huangshi Bank Insurance Regulatory Bureau as an example,the relevant situation of the banking industry’s consumer insurance working mechanism was introduced.Recently,problems in the current related working mechanism were discovered and the reasons were analyzed.In order to provide more reference and reference,this article uses comparative research and experience summary methods to focus on the advanced experience of the United Kingdom and the United States in the reform of the regulatory system,dispute resolution procedures,and the improvement of legislative protection in China’s Taiwan,and summarizes what is worth learning.Experience approach.On this basis,four measures were proposed to improve the consumer protection mechanism of the banking industry,including improving relevant laws and regulations,establishing a diversified complaint handling mechanism,establishing a sound behavior supervision mechanism,and establishing relevant assessment and incentive mechanisms. |
