Study On Legal Regulation Of Sharing Economy

Sharing economy is a new type of economy.In sharing economy,the idle resource providers share the idle resources with the resource demanders through the sharing platform.The usage right of the resource transfers temporarily during the trading procedure.As a new type of economy,there are conflicts between the sharing economy and the existing legal regulations due to the differences between the sharing economy and the traditional economy.Affected by this,the development of the sharing economy industry is gradually showing a sluggish state in recent years.In order to realize the goal of sharing economy as a new growth point and new driving force,it is necessary to perfect the legal regulation of sharing economy.However,the sharing economy involves a wide range of fields,and the legal regulation requirements are so complicated to list in detail.The application of shared travel is one of the most important branch of sharing economy,and also causes most problems among all kinds of sharing economy in recent years.Clarifying the legal regulation of shared travel application will help to improve the legal regulation of the whole sharing economy industry.Therefore,this paper starts with the outstanding problems of the three most representative shared travel applications: bike sharing,online car hailing and free ride,summarizes other common problems existing in the sharing economy industry,analyzes its causes,determines the principle and path of legal regulation of China’s sharing economy,and put forward the corresponding improvement suggestions,so as to solve these outstanding problems in the field of sharing economy,especially the application of shared travel,and create a healthy market environment of sharing economy.The paper consists of the following parts:Chapter 1: Introduction.Introduction of the research background,state the current situation of legal regulation of sharing economy of China and foreign countries and clarify the practical significance and ultimate purpose of perfecting the legal regulation of sharing economy.Chapter 2:Fundamental theory of sharing economy.Determine the basic concept of sharing economy by combing the literature at home and abroad,and analyzes its characteristics and legal structure.It lays a theoretical foundation for analyzing the problems and improving the legal regulation of sharing economy through these basic theoretical research.Chapter 3: Present situationof legal regulation of sharing economy.Introduces the development of sharing economy in China,state the legal regulation of sharing economy in China from the macro and micro level,and introduces the legal regulation of shared travel applications.Chapter 4: An analysis of the legal problems of shared economy and causes of the problems.Sharing bicycle,internet carriage and free ride are three most important branches of sharing economy.This chapter lists the most representative problems of these three types of applications and other common problems in the field of sharing economy,then analysis on the problems and their causes.Chapter 5: The perfection of legal regulation of sharing economy.First of all,determines the principles and paths to be followed in the legal regulation of sharing economy in China.On this basis,according to the problems summarized in the third part and the analysis of the causes,put forward five following suggestions: determine the legal status of the participants,improve the industry norms,improve the anti-monopoly law system,build a credit and security mechanism and improve the consumer protection system.In that way,the legal regulation of the current sharing economy is perfected.
