Dilemma And Resolution Of Online Shopping Contract Litigation

Online shopping craze has become a common model of consumerism in the Internet plus era.The rapid development of Internet and E-commerce has also emerged various online shopping platf orms,including taobao,micro stores,even direct B2 C shopping model based on social tools such as wechat.Since the traditional model ofconsumerism has been changed by online shopping and co nsumers’ shoppingbehaviour has extended from traditional store to virtual store.The resolutionof disputes of online shopping contract and litigation of Internet-relatedcontract seem to have been in more difficulty,especially with the deficiencyof laws and regulations.Fristly,the judicial practice of online shopping contract litigation,this paper first analyzes the basic characteristics of online shopping contract,through statistics of online shopping contract disp utes,analysis of litigation characteristics,looking for the problems of online shopping contract in tr aditional litigation and the impact on traditional litigation.secondly,from the formation of e-comm erce online court to Internet court From the operation of the Internet court after its establishment,th is paper tries to find out whether the difficulties existing in the jurisdiction,evidence,service and ot her aspects of the online shopping contract litigation disputes in the traditional litigation can be solv ed,and analyzes the existing problems and the new problems.Finally,based on the analysis of the causes and reasons,this paper tries to expand the jurisdiction and expansion of the Internet court H ow to solve the difficulties in the online shopping contract dispute litigation in the Internet courts is considered in four aspects: the large scope of electronic service,the unified electronic evidence rule s,and the expansion of diversified dispute resolution mechanism.It is proposed to establish a regio nal exclusive jurisdiction based on the three Internet courts,break through the jurisdiction restrictio ns of the e-commerce platform and the "consent of the litigant",and establish Specialized electroni c delivery mechanism,unified electronic evidence extraction and review solutions.Through the tar geted statistics and sorting of such litigation cases,the collection and research of scholars’ views,and the research and demonstration combined with the work practice,in order to learn from others and put forward the path suitable for solving the dilemma of network related contract litigation,more scholars may pay attention to this problem.
