On The Standardization Of Execution To Bankruptcy Procedure

The 2018 Central Economic Work Conference continued to point out the main line of supply-side structural reforms.Bankruptcy procedures,as an important system to promote highquality economic development,deepen supply-side structural reforms,and prevent major risks,should be subject to the current economic situation.Fully attached.However,the provisions of the Enterprise Bankruptcy Law and the Civil Procedure Law are relatively crude.In the“Interpretation of the Supreme People’s Court on the Application of the Civil Procedure Law of the People’s Republic of China”,implemented in 2015,Articles 513 to 516 establish the mode of implementing procedures to bankruptcy procedures.However,there is still no empirical analysis on how to set up the main body of the process,the starting conditions,the division of labor,and the circulation procedures.In particular,the specific operational modes and procedures are not clear,resulting in the practice of the court and the bankruptcy administrator.There are many difficulties.Therefore,under the existing legal system framework,it is necessary to study the process of standardization of procedures to bankruptcy procedures.In combination with the current implementation of bankruptcy practice,the author believes that the implementation of the bankruptcy procedure must start with the specific practice norms,and establish specific specifications at key nodes.In addition,the implementation of the transfer of bankruptcy cases and the simple and simplified trials are also the implementation of the formalization of bankruptcy procedures.The key lies in the feasibility measures.
